INFORMATION NOTICE
 
This text is intended to be a notification made to fulfill the obligation of informing Moda Sea Club Association (the “Association”) in accordance with Article 10 of the Personal Data Protection Law No. 6698 (the “PDPL”) and the relevant legal legislation.
 
 
  1. Your personal data are processed in order to fulfill the obligations as set forth under the Turkish Civil Code No. 4721, the Associations Law No. 5223, the Associations Regulation and other legislative provisions.
  2. In accordance with Article 5/2(f) of the Law on the Protection of Personal Data (KVKK), your camera recordings are processed for the purposes of ensuring the monitoring of entries and exits to the Club, supervision within service units and sports facilities, maintaining security, and protecting the legitimate interests of the Association.
  3. Your photographs are processed to be used in the Member Card that you will use within the Association, in the Membership Application Form and in the Association Registry Book pursuant to the Associations Law, based on your express consent.

  1. Camera Recordings
In accordance with Article 5/2(f) of the Law on the Protection of Personal Data (KVKK), your camera recordings are processed for the purposes of ensuring the monitoring of entries and exits to the Club, as well as for security within the building, service units, and sports facilities, and for protecting the legitimate interests of the Association. Only video images are recorded, and camera signs are visibly placed in areas where cameras are in operation. IT Department

Your Personal Data are processed for the following purposes:
  1. Determining and implementing activities and services in line with the objectives and working subjects specified in the Association By-Laws,
  2. Execution of the Association's Quality and Corporate Governance Policies,
  3. Managing and carrying out activities and processes for the members and representatives of the Association, such as the Association's General Assembly, Supreme Council Board, working group, commission, summit and other agenda member meetings,
  4. Establishing communication between the Association and its members on issues related to the membership rights and obligations, ensuring the relevant rights and fulfilling the obligations,
  5. Providing information about the Association's promotion and activities,
  6. Strengthening communication and cooperation within the Association,
  7. Reporting within the Association,
  8. Carrying out all security and inspection works of the Association's facilities,
  9. Being able to submit the necessary information and documents to these institutions and organizations upon the request of local and central governments and courts,
  10. Keeping books and records that are required to be kept by the Association in accordance with the applicable legal legislation
  11. Fulfilling obligations in accordance with the Associations Law No. 5223, the Associations Regulation and other legislative provisions,
  12. Carrying out all kinds of legal processes regarding members,
 
Since your fundamental rights and freedoms will not be harmed during data processing, the processing of your personal data indicated above are not subject to your consent. You do not have the right to request the deletion or destruction of your personal data until the end of the retention period required by legal legislation and procedures.
 
Except for the camera recordings, your personal data are collected directly from you, the data subject, verbally or in writing and recorded directly electronically.
 
Camera recordings are processed in accordance with the applicable provisions of the PDPL 5/2 (f) and as limited to the legitimate interests of our Association;
 
  1. Control of entrances and exits,
  2. Surveillance of areas with security priority ,
  3. Preventing criminal or criminal behavior, detecting crime, monitoring compliance with occupational health and safety measures,
  4. Observation of workflow and efficiency
 
You have the right to withdraw your consent to the processing of your personal data regarding the processing of your photographs at any time in accordance with Article 7 of the PDPL.
 
Your photograph, processed subject to your explicit consent, will be stored for the duration of your membership unless you withdraw your express consent.
 
Your personal data processed based on your explicit consent will be destroyed in the first destruction period following the specified periods.
 
 
Way of Collection of the Personal Data
Your personal data may be collected and processed verbally, in writing or electronically through the application form filled out during the application for the membership to the Association and the documents submitted physically or transferred electronically regarding the membership to the Association within the scope of the Association By-Laws, as well as through the information provided to the Association’s officials within the scope of various communications with the Association (phone or e-mail).
 
Automated decision-making systems are not used.
 
Retention Period
Your above-mentioned personal data, excluding the camera recordings, will be stored for 10 (ten) years in addition to the membership period.
 
Your personal data will be deleted, destroyed or anonymized during the first destruction period following the specified periods.
 
The camera recordings will be stored for one month. The recordings will be destroyed in one-month periods.
 
Transfer or Disclosure to Third Parties
The Association will be allowed to transfer your personal data to the following persons in the ways and cases as specified below in accordance with the basic principles of the PDPL and the conditions specified in Articles 8 and 9 of the PDPL:
 
Your personal data will be shared with the Istanbul Provincial Directorate of Civil Society Relations and other relevant public institutions and organizations during the period when your personal data are processed within the scope of Association Membership, in order to fulfill an obligation specified in any applicable legislation, including the Associations Law No. 5223 and the Associations Regulation.
 
If you take part in the Association’s bodies, your personal data will be shared with the Istanbul Provincial Directorate of Civil Society Relations and other relevant public institutions and organizations in order to fulfill various obligations as set forth under the Associations Law and secondary legislation.
 
The Association receives services from third parties or organizations for bulk e-mail sending, and in order to send you e-mails that will inform you about the activities of the Association and the activities carried out within the scope of the Association membership, your e-mail addresses will be shared within the scope of the legitimate interest of the association with the organization from which the service is received during the period of sending, provided that it does not harm your fundamental rights and freedoms.
 
In case of any dispute regarding the rights or obligations of your membership, your personal data will be shared with judicial and enforcement authorities by the Association's lawyers, consultants and data controller, provided that it is proportionate and limited to the dispute in question and for the establishment, exercise or protection of the Association's rights.
 
Limited to the activities within the scope of the Association's By-Laws and the above-mentioned data processing purposes, your personal data may be shared with domestic third parties and organizations such as consultants, financial advisors and auditors, from which the Association receives services, within the scope of its legitimate interest of the Association provided that it is mandatory for the establishment, use or protection of the Association's rights and does not harm your fundamental rights and freedoms.
 
The Association may transfer or disclose your above-mentioned personal data to third parties, including law enforcement agencies and public institutions authorized by law, without your consent, in case of an incident, in accordance with security procedures and/or in order to fulfill obligations arising from the law. Information regarding third parties and/or categories of third parties, to whom your data are disclosed in Türkiye, is always available for your information and review.
 
Transfer of Personal Data Abroad
The Association does not transfer your personal data listed above abroad.
 
In this regard, the Association acts in accordance with the regulations stipulated in Article 9 of the PDPL.
 
Your Legal Rights as Data Subject
 
  1. You have the right: to obtain information about how your personal data are processed (PDPL article 11/(a), (b))
  2. Learn the purpose of processing your personal data and how they are used in accordance with its purpose (PDPL article 11/c)
  3. Know the third parties, to whom your personal data are transferred (PDPL article 11/ç)
  4. Request correction of your personal data (PDPL article 11/d)
  5. Request deletion in case the reasons requiring processing are no longer valid (PDPL article 7, article 11/e)
  6. Request that these transactions be notified to third parties, to whom your personal data have been transferred, in case your personal data are corrected or deleted (PDPL article 11/f)
  7. Object to the results obtained in case of analysis of processed data (PDPL article 11/g)
  8. Request restriction of processing (PDPL article 7)
  9. Request compensation for damage in case of damage due to illegal processing of personal data (PDPL article 11/ğ)

The Association is obliged to take and implement all kinds of physical and administrative measures to ensure that your personal data are processed and preserved in accordance with the Law and to prevent unlawful access to these data.
